JYJ3 echoes DNBN in expressing our sincere sadness at the pains that the Indonesian fans have suffered due to the actions of its concert promoter.

Rebuttal on the False Rumors and Arguments Regarding the Cancellation of JYJ’s Indonesia Concert

Hello. This is DNBN.

Rumors with low credibility regarding JYJ’s World Tour Indonesia Concert’s cancellation.

We have come to draft this rebuttal in order to give you credible information after confirming the truths and reliability of the (below) materials regarding the cancellation of the concert.

Yesterday C-JeS announced that JYJ’s concert in Indonesia was officially cancelled. Fans of Indonesia, we cannot imagine how distraught you are. We express our sincerest condolences.

Unfortunately, right now, false rumors that blame a particular member for the cancellation is spreading in the international fandom. Because this rumor is being spread unilaterally by one side, we want to provide the other side so that you have more complete information.

This writing is not to argue that the cancellation is the fault of one side or to criticize the other.

Only, we wish that through this writing there will be no one who will believe that the rumors that are currently spreading are the truths.

Dream Catcher Indonesia (hereafter DCI) is the “official promoter” of JYJ Concert in Indonesia. DCI has never successfully hosted an event (previously it had worked with CN Blue and FT Island but ended up cancelling). The owner of DCI is a person named A.W. Ardiati. In press releases and other materials, it is shown that a person named Tita Ardiati is DCI’s President (see here). Tita Ardiati is also an administrator of the Indonesian TVXQ (not JYJ—they are “OT5”, i.e., supports only TVXQ5) Fanclub “Cassination.” In Indonesia, an “official fan club” is typically chosen to facilitate ticket sales. Unsurprisingly, Cassination was selected as the “official fan club.” However, DCI has long shown signs of instability—for instance, its CEO resigned last Friday.

Many of DCI’s actions regarding the concert preparation cannot be excused.

(1) DCI FAILED TO ADEQUATELY PRMOTE JYJ IN INDONESIA.

(a) It did absolutely zero promotion via TV or billboards, which are the traditional methods of promotion for concerts in Indonesia in which a substantial portion of the population does not have access to the internet.

(b) Even print promotions through the newspapers and magazines were extremely sparse (Short informational feature in the magazine IndoWorld and newspaper Pandeira were largely the entirety of this).

(c) In fact, even as late as March 22nd, DCI admits on its Twitter that it has not started its promotional activities. (See here)

(2) DCI HAS LIED MULTIPLE TIMES TO MULTIPLE PARTIES ON MULTIPLE OCCASIONS IN ITS HANDLING OF THE CONCERT.

(a) THE CONCERT TICKETS.

  • DCI sold the concert tickets in three different ways up to the day before the cancellation without having first obtained the consent and authorization from C-JeS. (See here)
  • DCI has misrepresented to the press and the public about the tickets selling out when they have not, multiple times, causing serious confusion to and hindering fans and potential buyers. In fact, there was much anxiety in the Indonesian fandom about just how well the tickets were selling because there was no accurate information.

(b) THE CAUSE OF THE CONCERT’S CANCELLATION

a. JAEJOONG: TITA ARDIATI, THE PRESIDENT OF DCI AND THE ADMIN OF CASSINATION, AND MANY OF HER CLOSE ASSOCIATES PUBLICLY SLANDERED JYJ MEMBER JAEJOONG WITH FALSE ALLEGATIONS. (For some examples out of many, see Tita Ardiati’s twitter at here)

  • Any allegations that Jaejoong personally has anything to do with Indonesia’s cancellation are obvious lies. In fact, Jaejoong has never even set foot in Indonesia.
  • The nature of the allegations was extremely defamatory towards Jaejoong and calculated to inflame the public opinion of Indonesian fans against Jaejoong.
  • Nonetheless, because these false allegations were made by such powerful figures in the Indonesian JYJ fandom, they are spreading like wildfire and are seriously hurting Jaejoong’s reputation in Indonesia and causing much anguish to his fans.

b. PRESS RELEASE: DCI AND ITS PRESIDENT TITA ARDIATI RELEASED AN OFFICIAL PRESS RELEASE THAT STATED THAT THE CONCERT WAS CANCELLED BECAUSE C-JES MADE ADDITIONAL HIGH-COST REQUESTS (see Press Release at here).

  • Tita Ardiati and her associates lost all credibility when they slandered and spread harmful rumors that hurt Jaejoong, who has nothing to do with the cancellation. All of their statements, therefore, warrant close scrutiny and suspicion as to their truth.
  • The press release is misleading and false in other ways. For instance, it states that DCI “worked hard to fulfill all that is needed for this concert” when, by their own admission, there were seriously inadequate promotions and many lies to the press and the fans about ticket sales.
  • The press release is also contrary to the announcement made by C-JeS which said that DCI’s repeated failure to abide by contract terms and its inability to smoothly carry out the concert are what led to the cancellation.

(3) DCI’S DESIGNATED OFFICIAL FANCLUB CASSINATION WAS AN INAPPRORPIATE CHOICE FOR A JYJ-CONCERT. IT IS “OT5,” I.E., SUPPORTS ONLY TVXQ5, AND HAS SOLICITED FOR AND PLANNED FOR “YUNJAE” EVENTS FOR THE JYJ CONCERT.

(a) Through their Tweeter and Forum, Cassination has repeatedly and explicitly condoned and encouraged fans to do activities that are disrespectful to a JYJ Concert, such as shouting names of people who are not part of JYJ. In fact, there is evidence that Cassination was making a Yunjae Banner to bring to the JYJ Concert and had plans to stage a high-profile Yunjae event. (See here)

(b) This shows a serious disregard for the respect owed to Jaejoong, Yoochun, and Junsu as people and artists.

We believe that C-JeS gravely erred in not monitoring Indonesia closely earlier. It is our sincerest hope that C-JeS will pull its weight on organizing these tours which are momentous occasions for fans. Nonetheless, the above events cannot be excused. Again, we express our sorrow at the events that took place in Indonesia—we believe that DCI wronged not just JYJ but also their fans in Indonesia.

Once again, we wish to express how saddened we are for fans who endured great suffering due to DCI’s above actions.

If there are individuals (and perhaps corporations?) out there investing millions of dollars into production companies for the use of promotion, expenses, etc; then why did SM have such a burden that they had to assign so much cost to be covered by their individual artists and groups? Where there is smoke there is fire.
So, if I am to understand this correctly–they are sueing C-JeS, and co. even though C-JeS says that the concert rights were transferred to Warner Korea who transferred them to KimXX? It sounds like selling bad loans. This opens up a whole new school of thought on coverage of concert expenses, profit vs non-profit concerts, and who gets caught holding the ball. Also, do any of those investment profits ever in any way benefit the artist themselves? Good Question. Hey, Folks. Give me some feedback here. [News] 110315 Investor in JYJ Concert Sues Rights-Holders for Fraud immediately after the hearing was over, articles like the below were plastered all over the Korean web:

Investor in JYJ Concert Sues Rights-Holders for Fraud

The Plaintiff Park XX sued Kim XX and C-JeS’s Director Paek XX, Warner Korea’s Director Whang XX, and others for fraud in Seoul Central District Court.

Park revealed in his complaint that “The Defendants conspired to deceive me and defrauded me of my wealth and so I sue.”

According to Park, the Concert Rights to the “JYJ Show-case Tour 2010″ of last year was transferred from C-JeS to Warner Music Korea. After that, it was transferred multiple times and (in the end) reached Kim XX.

Park said that “(he) was interested in the concert industry and from the introduction of a friend first met Kim XX. Kim said upon our meeting that he has the Concert Rights and that if [Park] invested, [Park] could make a very large profit, and recommended enthusiastically that [Park] invests.”

According to Park, he followed Kim’s advice and started to deposit money from October 7th of last year, and drafted an official contract on October 14th. The 5 locations of the concerts were Hong Kong and the USA’s Seattle, New York, San Francisco, and LA. The invested funds were to be used entirely for the concerts, and the budget for the cost of the concerts were to be notified (to Park) in advance. At this, Park invested 1,244,850,000 KRW (approximately $1,244,850).

Park said that “(he) requested proof of the details of the use of funds around October 20th of ast year. But Kim kept pushing it back with excuses of being busy.”
Park also argued that “contrary to what Kim said about his company’s state, Kim’s company had a lot of debt. It’s also been confirmed that he had intention to use the profits from the concerts to repay his debt.”

Park said: “Kim used a company that was already a dissolved company for tax purposes to contract, and he also concealed the fact that he has a debt load of billions KRW when we entered into the contract. Even the profits from the concert of 350,000,000 KRW(approximately 350,000 USD) were collected by the creditors and [Park] suffered harm doubly and triply.”

Park explained the reason for his suit in his complaint: “JYJ held a for-profit concert in Hong Kong on October 24th of last year. But the concerts in the 4 locations in the US, due to the fault of the C-Jes, were non-profit, not for-profit. The defendants did not provide a clear explanation [to Park] even though the schedules and the locations of the concerts were changed. Also no one informed [Park] of the above with official documents. [Park] did not recover one cent from the investment.”

To summarize, C-JeS transferred the concert right to Warner Korea, who transferred it to others, who eventually transferred to someone named Kim XX.

Kim XX, according to Park, told Park that the concert rights were a good investment and that Park should invest in them.

Park alleges that Kim defrauded him.

Please notice that C-JeS and Warner Korea are not involved in any way in this. By the time that Kim met Park, the concert rights did not even belong to C-JeS or Warner Korea. It belonged to Kim. This was a deal that was strictly between Park and Kim. It is unfortunate that Park decided to drag C-JeS and Warner Korea into this by naming the companies as co-defendant and extremely convenient for SM that the stories are being circulated moments after the JYJ-SM hearing is concluded.

Adding on, “There are friends that we know from Japan and those fans who support us and love us are in Japan, we felt very upset. We will pray from where we are that the disaster will pass soon and those people in Japan will be safe and free from hurt. Please be strong, everyone!”

Through their management company, JYJ expressed, “For the sake of those who have been upset because of this unforeseen disaster, we have plans to participate actively. We are planning to make donations that can help in the restoration of Japan.”

There is always something in the air these days. While we are concentrating, and rightly so, on the opportunities opening up for our guys with interviews, performances, and offerings of work–we cannot lose track of the fact that SM and other agencies are still trying to garner sympathy via the airwaves in their legal contract dispute with JYJ. Just recently, one more chapter in this saga unfolded in a way that was displeasing to JYJ fans.  Momma Cha

MBC’s ‘Sisa Magazine 2580′ released a report on the dispute between idols and their entertainment agencies but has fallen under a concentrated attack by JYJ fans. These fans of JYJ claim that the program was adjusted with a strong bias towards the entertainment agencies before it was aired.

On the 30th, ‘Sisa Magazine 2580′ aired an in depth report on the disputes between idols and their entertainment agencies as Kara’s proclamation to end their contract with their agency has brought up the controversy once more. The episode had garnered great attention before it aired for it was known that it would deal with JYJ’s situation as well, as they have been unable to appear on broadcasting channels due to their legal dispute after the disbandment of TVXQ.

However, many viewers expressed their disappointment after watching the show. Currently, complaints are flooding into the viewers’ thread. Viewers are showing their anger at the show stating, “You said you would handle the situation in a fair manner, but all you did was show the viewpoint of the strong side,” “If you’re going to report the situation in this kind of way, what makes you any different from the way entertainment shows are run?” “So what you’re trying to tell us is that it takes a lot of money to raise idol groups,” “You’ve done nothing but show the side of entertainment agencies,” and “This is a biased report.”

There are netizens demanding a fair report on the matter as SM Entertainment’s opinion received more air time in an interview with a SM representative while JYJ’s refutation was hardly shown. JYJ are holding the stance that they are not signed on to a dual contract as C-JES, the company in charge of managing JYJ, is their agency and not their entertainment company.

Some netizens have even criticized ‘Sisa Magazine 2580′ for randomly promoting a rookie girl group in the middle of the episode though they are not related to the report’s content whatsoever. While CEO Kim Kwang Soo was explaining that it is hard for entertainment agencies to gain profit when so much of the sales is spent on costs, the camera caught ‘Five Dolls’ rehearsing. ‘Five Dolls’ is the female unit group of ‘Co-ed’ that is preparing for their comeback.

Prain’s Head of Department Lee Jae Eun expressed her disapproval on her personal Twitter account when she stated, “They state that they will air a fair report but the amount of airing time the strong received compared to the weak is… Sigh…”

She continued to show her disappointment of the footage that was cut as she said, “In the interview, JYJ stated, “What’s most important is forming trust between artistes and their agencies. This new entertainment system will create a system of transparency that builds on a foundation of trust. We want to be treated like humans, not just objects to be sold in the market.””

Micky Yoochun, Xiah Junsu, and YoungWoong Jaejoong, who garnered explosive popularity in Asia as members of TVXQ, filed an exclusive contract suspension injunction against SM Entertainment in July, 2009 claiming that their contract was unjust. Afterwards, JYJ restarted their activities but have been facing troubles when it comes to appearing on broadcasting channels due to their legal dispute with SM.
