Mr. Yuichi Sasahara, the CEO of EMusic, has posted various messages defaming the honor of C-JeS and C-JeS artistes JYJ through mediums such as Twitter. C-JeS took action against Mr. Sasahara and issued a warning through our Japanese lawyer, demanding that he cease all acts of defamation, but he has not done so.

Our agency and legal representatives have come to the conclusion that taking action against and mentioning the false information and rumors spread by this individual will only worsen the situation, so we and the members of JYJ have agreed to not mention Mr. Sasahara on social networking systems (SNS) or give him our attention anymore. We have come to the conclusion that ignoring Mr. Sasahara is the best way to eliminate this issue.

We please ask JYJ’s fans to follow our lead and refrain from mentioning Mr. Sasahara on SNS in order to stop false information and rumors from spreading in the future.

Hello.

Last year, our company declared war against vicious netizens who spread malicious rumors and attacks against JYJ.
The crimes of some vicious netizens have been  proven through countless lawsuits we have filed against them.
However, we would like to post the following notice as the number of incidents involving false rumors and malicious attacks being made online against the members has not decreased.

1) Our company has a special task team in charge of dealing with malicious netizens online, and they do their own monitoring and check over the screen-capture material that fans send in. This team is also in charge of a process that reports and files for legal compensation at investigative organizations, such as the police, when a crime has been verified.

2) In the case of the person who is active in DC Gallery under the ID ‘Holic’, they have not received a criminal penalty because they are a minor, and we are currently preparing a lawsuit against their parents instead. Because the truth of the crimes of ‘Holic’ have already been recognized, we ask that everyone deals with the posts of ‘Holic’ by not responding to them at all, and screen-capturing the evidence and reporting it to us. The same applies to ‘Sasahara’, who we talked about on our Japanese homepage. We are currently locked in a lawsuit with him at the Tokyo District Courts. Also, we would like to stress that we will not engage in any favorable agreements or settlements with malicious netizens.

4) We will continue to post notices when verdicts are made on our lawsuits in order to stop these instances from recurring.

JYJ has filed a 100 million KRW damage suit against the media who earlier reported about dispute with sasaeng fans.

According to revelations in law industry, JYJ has filed a 100 million KRW damage suit on the 1st of August in Seoul Central District Court against internet media ‘D’ for reports on abusing sasaeng fans.

JYJ’s representative states that, “Without any confirmation with the party involved and to reveal illegal audio files, it is a form of defamation and invasion of privacy. We ever mentioned to media in March about filing a criminal suit against the said media but after discussion, we decided that a civil lawsuit would be more suitable to this issue. Therefore we retrieved the previous lawsuit and once again filed a civil lawsuit.”

‘D’ media reported in March claiming that JYJ members abused sasaeng fans physically and verbally and revealed a related audio file. JYJ’s representative C-JeS entertainment stated officially its strong stance against this issue and expressed that, ‘This report is a malicious report for attacking JYJ members.’

It has been a year since JYJ has started anew with the worldwide album released all throughout the world. They are continuing their shining achievement as world stars—the musical achievement of the successful holding of a 10-country world tour and activities as the global honorary ambassadors for a UN agency and for many governmental units and corporations.

We think it is the same for the fans of JYJ as well. Every time there is a performance there is a high-quality culture of viewing and day after day there are beautiful donations by the fans. The sound fan supports, rice donations, and interest for the products for which JYJ act as models makes the industry affiliates surprised. The satire advertisements on newspapers, bus, and subway stations that call for JYJ’s broadcast activities acted as impetus for the media to recognize the high quality of the JYJ fandom culture.

C-JeS Entertainment, which is in charge of JYJ and their management, always respect the fans and we deeply thank you.

However, nowadays among fan communities, there are those who call themselves “fans” and for the reason that they are “fans” the create rumors about members and make personal attacks. Until now we dealt with the incidents individually but today we give an official notice of stern warning from the management.

We will not recognize the people who have defamed any member of JYJ with the creation of baseless criticism and rumors to be “fans” and we will take legal measures with clear evidence.

If the posts are not deleted or if this kind of activity repeats itself after one week from this warning announcement is made, we will submit those evidence and inquire investigation to the Cyber Terror Response Center.

This is more than merely a distorted heart of a fan. It is a serious crime. We ask the fans to understand and respect this announcement.

The three members of JYJ are more than merely members belonging to a group. Further, we ask you to please look forward to the good music and great activities that will be brought under the name of JYJ.

서울강남경찰서는 9일 화장품업체 W사가 인기 아이돌 그룹 동방신기 소속 기획사인 SM엔터테인먼트를 명예훼손과 업무방해 혐의로 고소한 사건과 관련, SM엔터테인먼트 김영민(40) 대표를 불구속 기소 의견으로 검찰에 송치했다고 밝혔다.

The Seoul Police, Kangnam Division, revealed on the 9th that it had sent an indictment on the CEO of SM Entertainment, Youngmin Kim (40), to the Public Prosecutor’s Office in relation to the lawsuit that the cosmetics company ‘W’ has filed against SM Entertainment for defamation and obstruction of business.

김 대표는 지난해 동방신기 멤버인 영웅재중, 믹키유천, 시아준수가 그룹을 탈퇴하고 SM엔터테인먼트측을 상대로 전속계약을 끝내달라는 소송을 내자 “동방신기 멤버들의 소송은 화장품업체에 투자해 이익을 얻을 욕심 때문이었다”고 말해 W사에 의해 두 차례 고소당했다.

The representatives of ‘W’ state, “The CEO Kim is attempting transfer all responsibility and blame for the departure of the three members of TVXQ on us and this has consequently gravely damaged our corporate image”. They also added, “SM Entertainment publicly threatened our operations in China with a civil or criminal lawsuit, which has incurred further damages and led to the loss of our security deposit.”

경찰은 “동방신기 세 멤버는 장기 전속계약을 끝내달라고 소송을 낸 것이지 화장품업체 투자와는 무관하다”고 판단했다. 지난해 10월 법원은 동방신기 세 멤버가 SM엔터테인먼트를 상대로 낸 전속계약 효력정지 가처분신청을 일부 받아들였다.

이에 대해 SM 엔터테인먼트는 “우리는 이 문제로 W사 이름을 밝힌 적이 없으므로 명예훼손도 없었다”고 말했다.

The police already concluded that “the three members of TVXQ filed the lawsuit against [SM Entertainment] in order to have their long-term exclusive contract with their management company declared invalid; their legal proceedings have noghitng to do with their investment in a cosmetics company.” In October of last year, the Court upheld the preliminary injunction submitted by the three members of TVXQ to have the effects of their exclusive contract nullified during the duration of the lawsuit. SM Entertainment continues to affirm, “we have never mentioned the name ‘W’ in relation to this problem and have thus never commited defamation.”
