Will the doors of broadcasting companies open for JYJ, who have been locked in a legal battle with their former agency SM Entertainment?

Following the announcement on the 28th that SM Entertainment and JYJ reached an agreement after three years locked in a legal battle, many are curious to see if this will lead to an appearance in broadcasted TV shows by JYJ.

For example, in May of 2011, KBS explained the reason why JYJ were not to appear on variety shows such as ‘Music Bank’ when they stated, “JYJ’s lawsuit has not ended with their former agency. It is normal for us to wait and refrain from casting celebrities who are locked in legal battles, as their appearance on TV shows may influence the results of their lawsuits.”

Now that an agreement has ended the lawsuit, the spotlight has shifted to the three main broadcasting companies. Many are curious to see if the end of the lawsuit that has freed JYJ from restrictions will give them the chance to appear on music programs or variety shows.

Regarding this, Jeon Jin Guk, the director of KBS’ variety sector, stated in a phone conversation with OSEN that, “We heard the news through an article. I believe the details of our stance on the issue will be solidified through further discussion,” and “I don’t believe there will be any reason for us to refrain from allowing JYJ to appear on KBS TV shows if their lawsuit has come to a complete end, as that was the reason for our actions.”

MBC’s Won Mak Sik stated, “Though the lawsuit between the two parties has ended, we believe it is a problem that requires time to observe the situation.” Another representative of MBC’s variety sector explained, “We have not yet discussed the possibilities of JYJ appearing on music programs and variety shows,” and “This is an issue that must be considered by the entire variety sector.”

PD Park Seung Min of SBS’ ‘Inkigayo’ gave a short statement of, “This is an issue for the entire variety sector to discuss. I can’t say much because there hasn’t been any discussion as of now.”

Another week has gone by with JYJ’s appearance on KBS 2TV’s ‘Music Bank’ falling through.

According to the Korea Communications Commission, KBS has stated that they have kept their former stance regarding JYJ’s appearance on ‘Music Bank’ that, “Appearing on broadcasted programs may affect the outcome of celebrities’ lawsuits, and we will continue to review the possibility of JYJ’s appearance on the show as we keep an eye on the situation,” and also stated, “We have not changed our stance that as the group is currently involved in many lawsuits regarding the results of their injunction, the validity of their exclusive contract and compensation, we will continue to postpone their appearance and keep an eye on the situation till the final verdict is made, regardless of the outcome of their injunction lawsuit.

They then added, “Though the situation keeps changing with the content of their injunction and release of their album, there is still a lawsuit going on between SM and JYJ, and as the courts have not made their verdict on the issue, the staff of ‘Music Bank’ have not changed their stance on the issue.”

But in May of this year, KBS released an official statement that is slightly different from the one they produced recently. At the time, KBS stated, “According to the staff’s criteria that an appearance is decided upon only after the release of an album, JYJ are not qualified to appear on ‘Music Bank’ as they have not released an album since the courts made a verdict on the 17th of February,” and “The selection of appearances lies solely in the staff’s decision and they will further discuss the possibility of JYJ appearing on the show after JYJ have released an album.”

As JYJ have been unable to appear on a single music program since they split from TVXQ, JYJ and their fans found hope in the official statement of ‘Music Bank’. And when JYJ released their first Korean album ‘In Heaven’ in September, many focused their attention on whether JYJ would be able to appear on ‘Music Bank’ or not.

It’s been over a month since the audio files of ‘In Heaven’ were released and not only have JYJ not received a single invitation to appear on a music program, but even ‘Music Bank’, on whom many had placed their hopes, completely changed their stance and have become the target of JYJ and their fans’ disappointment. With KBS’ ridiculous change of heart coming to light, it makes one wonder if they ever even considered allowing JYJ to appear on ‘Music Bank’ in the first place.

What’s most difficult to comprehend is the fact that JYJ’s name can’t even be found on the show’s ‘K-Chart’, which focuses more on objectivity than most other music programs as it takes into consideration digital audio file downloads, album sales, number of times a song is broadcasted and public preference.

Even if JYJ were unable to appear on the show like KBS stated, they should at least be included in the ‘K-Chart’ and be able to compete with other singers. Allowing a singer to appear on a show and having that singer’s music included in music charts are two completely different issues. If KBS did not allow JYJ to appear on ‘Music Bank’, even if they were to grab the number one spot on the ‘K-Chart’, this wouldn’t clash with KBS’ current stance. The fact that the group isn’t even considered on the charts is only deepening their fans’ suspicions.

Regarding KBS’ official statement, JYJ’s agency C-JeS Entertainment stated, “KBS must show proof that they are making the decision on JYJ’s appearance with the same criteria that they are using for all celebrities who are currently appearing on their programs,” and “If KBS respects the verdict made by the courts, we believe it is only right for KBS to take full responsibility in ensuring that they stay fair and execute the courts’ verdict that guarantees JYJ unrestrained independent activities.”

KBS and JYJ’s disputes continue to pile up with KBS’s surprise cancellation of JYJ’s performance in the ‘Jeju 7 Natural Wonders of the World Special’ and KBS’ unjust review of ‘Pierrot’. But a large portion of the public refuses to accept the current situation of JYJ being unable to appear on music programs. JYJ’s Kim Junsu, Kim Jaejoong and Park Yoochun, who are unable to appear on ‘Music Bank’ due to their lawsuit with SM, is currently hitting it big through dramas and musicals. It can be seen from Olleh music website that the tracks from JYJ’s first korean album “In Heaven” (which includes the songs revealed in JYJ’s world tour) occupied the 1st, 2nd and 3rd spots for two weeks continuously. The difference with other artistes who released songs during the same period of time was that this achievement was done with no participation in any music programmes, thus heightening its meaningfulness. Furthermore the album that was slated to be released on the 27th, has already received more than 300,000 pre-orders, resulting sold out in various online music stores. Fans from Japan, China and various Asian countries have placed their pre-orders as well, causing insufficient supplies. Nonetheless, JYJ was still nowhere to be seen in any music programmes.

JYJ’s management company C-JeS Entertainment said, “There was no invitation to any programme. It could be due to the album yet to be released. We are still monitoring the situation.”

C-JeS further expressed, “In May, with regards to KBS’s stance on performance broadcast restriction due to lawsuit with ex-company, we have officially presented that the court has ruled twice in our favour for JYJ’s non-restriction activities, i.e. the ability to perform. KBS has accepted such rulings and had expressed that should JYJ officially released an album, they would be able to participate in performances without any problem. We believed in such integrity and hopefully JYJ will be able to participate in the programmes for the fans who have been supporting them.”

However, the activities for JYJ were not emphasized on programmes afterall.

JYJ’s marketing representative expressed, “The activities in the later half of the year for JYJ includes their first visit to Spain, Germany etc, for their concert tour. There is a Japan concert as well, thus we are trying to reach the audience in various ways other than programmes.”

JYJ’s latest MV for “Get Out” has met the audience officially through LG Electronics’ CF. In 2011, they are also eagerly helping the less fortunates as honorary ambassadors.

JYJ (Kim Junsu, Park YuChun, Kim JaeJoong)’s fans were not able to see them on boardcast channels so they released a press media to satirize about this issue and it’s catching a lot of attention.

The advert reads,”On moonlit night on the last day of the month a document secretly handed over. Fret not about the 3 childen who is an eyesore there won’t be an issue. No matter what the judge says, believe in the entertainment country. [T/N: Translated as accordance to the direct meaning of the peom!]” and a picture of a woman who puts a TV on her head and a man who wore a mask was following right behind the woman was included along with the poem. The advert is trying to say that because of the on-going issue that JYJ has with their previous management company, they were not able to appear on boardcast programs and their previous management company has a certain amount of influence on these broadcast companies.

On the other hand, JYJ fans requested that KBS give a formal reply with regards to the reason why JYJ is not able to attend ‘Music Bank’ and KBS replied saying, “Because JYJ who still has an on-going lawsuit, does not have an album released after 17th February and plus the circumstances differs from singers to singers who qualify to make appearance in the show, JYJ did not qualify. And, “On an additional remark, the OST that JYJ has released did not qualify to the subject.” Adding on, “About the selection of performers, it’s at the sole discretion of the production crew so until JYJ releases a new album or has some work, thereafter the production crew will decide.”

Fret not about the 3 childen who is a thorn in your eye because there won’t be an issue. – there’s no need to even worry about those 3 children standing in your way for they won’t even be able to appear on TV as of what you’ve wanted it to be.

No matter what the judge says, believe in the entertainment country- The entertainment country do not follow the decision made by the judge and that they have their own rules and laws that they adhere to.. It begs to differentiate the different kinds of world the broadcasting companies are standing at and their viewpoint on issues and how the judge views on the issue. In short, it shows that the entertainemtn industry is like a separate country ruled by their own laws and not follow what the judge said.

Notice that single chinese character in the whole chunk of Korean words?
It means “country” in Hanja Character. The writer is trying to stress the meaning of the line of that poem. Although in Korean 예능국 which means “Entertainment Department” has the same writings as the word “국” in Hanja Character, the writer has used the chinese character to stress that the entertainment department is a country of its own and has its own set of laws and regulations which is overruled by the judgement of the judge or simply put, anyone beides those in that entertainment country ie. SM Entertainment and Boardcasting compaies.

A closer look into what the picture says

The picture shows a woman, a man and a frog. If you take a closer look at their expressions, the woman look frustrated and the man has a sheepish look. Note that his hand is grabbing the arm of the woman. The picture, according to the dressings and hair styles, protrays an image of ancient Korea. In Korea culture, it means a lot for a man to grab a woman by the arm in public area – it could be viewed as harrassement.

The woman balances a TV on her head which represents the Entertainment Country. The man behind her represents the management companies. It is well-known that Lee SooMan, CEO of SM Entertainment has a nickname call “toad” or the “wine toad” because of his looks and because he once invested in winery. Thus the toad represents him. The toad is glaring at the man and woman. Management companies buy the good looks of the Entertainment Country so they can dominate and rule it; like how a man rules his woman.

On May 2011, after over a long period, KBS claimed that the sales of the OST which accounts to the counting of K-Chart will be exempted and “Found” which counted towards the K-Chart in 2010 was exmpted for the reason being the rules that runs the charting has differs in 2011 from that of 2010 was revealed on January 2011.

3. [Kim Seung Woo’s Win Win] Denied of Appearance
On March 2011, JYJ’s member Park YuChun was supposed to appear as ‘Unknown Guest’ of Kim KamSu’s episode on Win Win. However, on the day that he was supposed to appear on the show, he suddenly received a notice saying that he’s not qualified to attend the variety show. With regards to this, KBS has yet an acceptable explaination for it.
