Here we go again. Another cancellation. I’m truly not surprised anymore, just plain irritated. I guess JYJ isn’t morally grounded enough to appear before the TV audience and/or the world as Jeju’s honorary ambassadors? Honorary does have a meaning, right?

Give me a break!! Which agency is responsible this time? We can probably make some accurate guesses as to the political machinations that have attempted to make this last endeavor invalid, and to be honest about it, by this stage it is just ridiculousy juvenile.

Maybe some other country wants to make a bid for the 7 Wonders nomination, maybe SM or Avex simply wants to have one of their acts represent Jeju, or maybe, just maybe, it is just a case of Mr. Nasty disease from KBS once again.

I guess we’ll just wait to see what information will be provided by C-JeS, and who will take responsibility. Until then Jaejoong, Yoochun, and Junsu–no one deserves a break more (accept maybe your brothers inside SM). You work so hard and you are dearly loved. <3 to the nth degree. 🙂 Momma Cha Addendum: There are other voices who feel as if KBS may, as has happened before, be the culprit here. There certainly is evidence from the past of KBS' tendency to schedule, receive promotional benefits, then cancel JYJ or JYJ individual member's activities. It has been affirmed through C-JeS that KBS has broken their agreement with JYJ to be the honorary ambassadors for N7W, which included the special broadcast program on the 20th of July. Has everyone become arrogant and starting to feel as if they have immunity in mistreating JYJ? This has to stop. Justice must be served. Addendum No. 2: It appears to me that KBS has something about them that others can manipulate and use for their own selfish purposes. Even if it is true that they originally asked SNSD et al to represent the N7W campaign, they also originally asked JYJ to do the same. Both had scheduling difficulties but JYJ managed to somehow answer their request and do the promotional work. JYJ got votes for Jeju from all over the world, and inspired people to want to come from all over the world for the event. This is mismanagement on the part of KBS, SM, and hopefully not C-JeS. Regardless of who did or didn't manipulate, drop the ball, etc; it just boils down to one thing, our guys were used and thrown away in the process. Even though the raging topics, why did you decided to step in with musicals from the start?

“It’s just the right timing. Although I did received projects from movies, dramas and there are free slots in between schedules…. but compared to anything, music is still the most important. So I was thinking since it a must to have music, why not take a try at musicals? When I first acted in musicals, I did not think that I would end up loving it. (laughs)”

After the debut musical ‘Mozart’, you were asked to lead in ‘Tears of Heaven’, this simply is a follow-up victory.

“I seems to have slightly understood what musical is about until recently. In the beginning, it felt very tiring even though there’s no mistake made, now I’m slowly learning through the amicable cooperation with the other actors… and starts to notice the reactions of the audience. Thus the musical performances for every day is different.” He continued introducing the so-called ’3 seconds difference’ on stage. “There is a scene in Mozart where I followed the Baroness, how many seconds should I back-faced the audience after finishing my lines so that I can display to the audience the feel that I wanted? The most suitable timing is about 3 seconds. (laughs)”

Other than this, he was often pointed out that his delivery of lyrics was not as strong as professional musical actors.

“Singing in musical is totally different from singing songs. For example, the usage of ‘banding’ (a singing technique where the note was dragged and blended into the next word) was not appropriate. The lyrics has to be sang out one word by one word. Compared to other actors, maybe it was not easily differentiate but it would still be better that l changed my way of singing.”

As a musical actor and actively as an idol singer, do you feel that you have slowly became closer to any character?

“But if I were to stand on JYJ’s stage now and to sing with my way of singing in musical, it would probably be a torture to the members. Even my hand signals has slowly increased. (laughs) I think for me right now, it is to slowly forwarding towards the way of ‘Even if I was a singer, I’m also a musical actor.’ Just as though there’s a switch in between the two, where I can freely move around.”

There were a lot of controversies. Like the rumours of ten millions of performance fees and the ability to become the male lead due to the investment by the company (you belonged) etc. When asked about the question of ‘idol glamour’, Kim Junsu surprisingly gave a calm and outright attitude while giving an answer.

“I understand that the choir department actors were able to stand on stage after working hard for a long while. I received this ‘gift’ of being the lead actor after my hardwork as a singer, this is at least how my thought is. As for the high performance fee rumours, I think it’s not only in musical that there are such rumours right? No matter it be drama or CF, there were many issues for the receipt of fees that broke records too… It’s just that the musical industry was so bad and thus the unique appearance of such rumours, right?”

Do you have any contributions that you wanted to do or ambitions that you have in the future involvement into musicals?

“Next year, or the year after, I would like to act in theatres. If I can be ambassador-like and create the effect of supporting musicals, it would be a rather grateful thing. But to do till such, the first step should be having audience who watch, and to have the love of the public, then the public performance can be a success, and followed on by more investors. Therefore, the production company and actors will be able to create a more fruitful work, and afterwhich wouldn’t there be a possible promotion to overseas?”

“It’s currently still in an unclear state. Due to the difficulties currently, we just have to try working in other directions, this is very exhausting. If there were things we wished to do, we’d have to think about how to do it in another way, and then not to give up on any hope.”

He is currently a young adult of 24 years old, are there any plans for army enlistment? He jokingly replied, “When performing the story in ‘Tears of Heaven’, I ever thought, ‘Why not bring forward the enlistment, it actually would be not a bad experience, isn’t it!’.”

“I received a health check last February and of course it’s a must to enlist for army. (laughs) The results for the health check is 3rd grade (note: 3rd grade is for person who had injuries but still able to be enlisted in army and an approximate of 22 months.) There’s a bit of disappointment for the results. I’m a man afterall, and has the pride of a man, I thought the results will be of 1st grade. Hopefully I can be enlisted after maximizing the activities I can do.”

We asked about the greatest change after involving in musicals.

“During the empty period (lawsuit with SM), musical came to me, and now I only listened to music from musicals. I hope to become an actor who is able to inspire and touch the audience.”

Fair Trade Commission Issues SM Entertainment to Revise Idol Contracts 23 December

Firm Orders were Given.

SM Entertainment received a firm order from the Fair Trade Commission to revise the unfair contracts which bind SNSD, Super Junior, SHINee, and many others to them.

On December 23rd, the Fair Trade Commission stated, “We gave them a warning to voluntarily correct the unfair exclusive contracts that their celebrities and trainees have signed. [SME] is to reduce all contract lengths by three years.”

This decision by the FTC was based off of a complaint made by TVXQ’s fanclub, Cassiopeia. The group alleged that SM Entertainment was using their status to pressure a disadvantaged (’slave’) contract onto TVXQ.

SM Entertainment’s violation, as disclosed by the FTC, lies in the unfair contract conditions. These conditions included forcing artists to sign on for a long period of time, an excessive penalty provision for breach of contract, and a one-sided scheduling of activities. There’s also a clause that allows SME to extend contracts for overseas activities without first consulting the artist in question.

According to the FTC, these contracts from SME would run ‘for 13 years starting from the day of signing‘ or ‘exceeding 10 years from the day of debut.’ In compliance with the FTC, however, SM Entertainment changed their contracts to ‘seven years from the day of debut.’

If the artists decided to terminate their contract prematurely, they were subject to heavy penalties. Artists were forced to pay three times the investment amount, plus two times the amount the artist was to have made during the entire length of the contract. In short, even though the contract was terminated, these artist would have to pay double the amount of money they would have made in ‘x’ years left.

Because of the FTC order, however, this was changed to artists now paying an average monthly sales of two years before the contract termination, multiplied by the number of months in the remaining period.

The entire clause allowing activities to be scheduled without the artist’s consent has also been removed. It has been replaced with, “All celebrities of SM Entertainment may include their opinion at any point and ask for the appropriate document copies regarding their career from SM. SM has the right to refuse should the request be unjust.”

This new revision is expected to make an influence on JYJ’s case as well.

Spanning from July of 2008 to July of 2009, the schedule is deemed to have been ordered and sorted by a TVXQ fan and includes the phrase ‘This excludes some activities such as photoshoots for magazines, music recording sessions, filming for MVs, filming for DVDs, photoshoots for photobooks, and filming for CFs.‘

The schedule surprised many as it shows an endless repetition of flying in and out of the country with at least 3~4 scheduled activities per day and little to no rest.

서울강남경찰서는 9일 화장품업체 W사가 인기 아이돌 그룹 동방신기 소속 기획사인 SM엔터테인먼트를 명예훼손과 업무방해 혐의로 고소한 사건과 관련, SM엔터테인먼트 김영민(40) 대표를 불구속 기소 의견으로 검찰에 송치했다고 밝혔다.

The Seoul Police, Kangnam Division, revealed on the 9th that it had sent an indictment on the CEO of SM Entertainment, Youngmin Kim (40), to the Public Prosecutor’s Office in relation to the lawsuit that the cosmetics company ‘W’ has filed against SM Entertainment for defamation and obstruction of business.

SM Entertainment continues to affirm, “we have never mentioned the name ‘W’ in relation to this problem and have thus never commited defamation.”

Lastly, CEO Baek said, “Recently, JYJ have been chosen as honorary ambassadors for publicity projects led by the nation and various groups and have been enhancing national prestige. Therefore, it saddens us to see that others are claiming that JYJ are disrupting the order of the cultural industry.”

The network’s entertainment news program, “Section TV Entertainment News” has been revealed to have also snubbed coverage of Yoochun’s new drama, “Ripley“, right after they cancelled his appearance on the variety show, “Come To Play” not too long ago.

“Avex sold CDs and DVDs without consultation with C-JeS (which is JYJ’s Korean management company) even though it had unilaterally suspended JYJ’s activities. Our fans (Japanese fans) who had been watching silently in the meanwhile reached the limits of our patience when Avex interfered with JYJ’s charity concert in Japan. The popular 3-person idol group JYJ (Park Yoochun, Kim Junsu, Kim Jaejooong) is facing a difficult time with regards to appearing on domestic broadcasts due to the after-effects of withdrawing from TVXQ. When Avex put the brakes on to make even its Japanese activities become difficult (to materialize), JYJ fans have stood up to action.

The direct impetus is from the time of the relaying of the news that JYJ’s plans for a large-scale charity concert in Japan to help the victims of the March 11 earthquakes (June 7) has been put in danger of foundering due to Avex’s sabotage. It is that the discontent of the Japanese fans which had been seething at the treatment of Avex to announce the suspension of JYJ’s activities suddenly in last October has exploded at the potential of the concert’s foundering.

When a few Japanese fans drafted a “demand letter” to Avex that demanded the resumption of JYJ’s Japanese activitieson the 19th of last month, within less than one month more than 10,000 fans participated in signing.

The result of asking the opinions of Japanese fans on this situation through Twitter is that within a few hours more than 200 writings flooded the newspaper. As the pointing-out of the Japanese fans mentioned earlier, the writings are mostly of the content that one cannot understand the behavior of Avex.

That Japanese fans stand up to take collective action to publicly express an opinion for a Korean Wave star is an extreme anomaly.

In particular, the date of JYJ’s charity concert coincides with the date that TVXQ performs in “Seoul-Osaka Music of Heart 2011, Fighting Japan!” and so suspicions are becoming focused on the circumstances surrounding its cancellation.

According to a recent press release from C-JeS, JYJ had planned to hold a charity concert on the 7th of next month in the Saitama Super Arena which has the seating capacity of approximately 20,000 and had even finished the contract to rent the venue but suddenly was notified of the contract’s cancellation.

JYJ showed themselves to be actively sympathizing with the pains of the disaster, donating 600,000,000 KRW (approximately 600,000 USD) immediately after the earthquakes, saying that they “would like to return the help received from the Japanese fans.”

Perhaps due to this, among some fans there are responses that say: “It is too much to interfere even with a charity concert” and “I am ashamed to be a Japanese.”

The Twitter ID @eyua raised a question: “At this time when due to the nuclear issues many foreigners are returning home (away from Japan), JYJ says that they want to come in order to help in the revival of Japan, out of good will as human beings—why is this not allowed?”

C-JeS pointed to Avex as the forces behind the cancellation of the venue’s rental, saying that “Avex’s sustained and relentless sabotage attempts became the fuse of this incident (of the contract’s cancellation).” At this, C-JeS hurriedly contracted with another venue but it has become known that whether the concert will be held or not is currently unclear.

Paek Changjoo, director of C-JeS, said in a phone call with that “in order to accomplish the concert in any way possible, we are in the middle of persuading the venue affiliates and others.” JYJ’s charity concert began selling tickets on April 5 and is known to be sold out as of now.

Prior to this, director Paek wrote on the home page to the Japanese fans, asking for understanding that: “Because the Japanese fans had been waiting for JYJ’s stage for a long time, we thought of even cancelling the concert because we could not show a properly-equipped concert. But in order to keep the promise with many fans who had waited for JYJ in trust and in patience, we decided to push ahead with the concert.”

Director Paek revealed that even though Avex officially contracted with C-JeS regarding JYJ’s Japanese activities last March which is after the division of TVXQ and so recognized JYJ’s activities within Japan, in October of last year suddenly notified the “suspension of activities” of JYJ within Japan.

Director Paek revealed: “On the surface it is raising as reasons my personal issues and that (JYJ is) in the middle of a conflict with TVXQ. But in truth, it seems that it is attempting to take the rights relating to the management of the international activities of JYJ.”

The Japanese weekly recently reported that on this, Avex revealed: “Because the 3 of JYJ are singers attached to Avex, the concert contract is a clear breach of contract. Further, as we see it, (even though this event is a charity concert) this event has a profit-making motive. Currently we are filing for an injunction on the infringement of business rights.”

However, Japanse fans asked back in the demand letter: “If Avex argues that it did not know the past of the director of C-JeS prior to the signing of the contract and claim that this is the cause of the suspension of the contract, then is it not that they were negligent on their obvious (duty to the) task of prior research and examination of a company that is an object of collaboration?” Further, on the reason of being in conflict (with TVXQ) the demand letter also pointed out that: “By the April of last year when JYJ resumed its activities in Japan, the problem of confirming the exclusive contract between the 3 and SM had already been resolved through the (injunction judgment of the) Korean Court of October of year 2009.” It argued that: “Therefore the issue that Avex raises as the reason for the suspension of the activities – that “there is a possibility that the exclusive contract itself may become invalid according to the results of the trial” – is already meaningless.” Because the Japanese market is the biggest market for JYJ, if they find it difficult to be active there it is expected to be a large blow.

JYJ, which his currently in a conflict with the mega-entertainment agency SM Entertainment (hereafter SM) won against the Objection and the Injunction to Suspend the Effects of the Exclusive Contract (contract between JYJ and C-JeS) and was guaranteed independent entertainment activities until the main suit is decided. However, public broadcast stations and cable and satellite broadcasters are being wary of SM and other mega-entertainment activities and are avoiding their appearance on music programs. Director Paek said: “The results of the lawsuit is currently not affecting the appearance on broadcast at all.”

Therefore, JYJ is concentrating on tours outside of Korea, including Japan.

JYJ’s 4-time Asia Tour which kicked off in Thailand on April 2nd through 3rd gathered approximately 43,000 fans.

News: 110429 JYJ Sues Japanese Agency Over Cancellation of Concert

WHEN you are dealing with human rights issues, they cannot be resolved quickly unless either mutual respect on both sides leads to early resolution, or a timely process is employed to resolve the issues. In the case of JYJ against the established entertainment cartel, this is going to be a long, drawn-out process. I anticipated this was going to happen so I have always cautioned that the process was just beginning. Those of us who truly love our mancubs, not their bodies only, or their music only, but love their spirits, souls, and personalities will have to hold in and continue to pray for resolution that benefits the common good. I believe that Avex has been using JYJ and other artists to solve their money issues and to fufill their corporate goals with disregard for the artist’s human rights, as has SM and all of the United Management Companies, et al.. Artists are so much more than talent and box office appeal–they are human beings with desires and hopes of their own. It can be hard to work for years toward someone else’s dream. I have lived this. IN this particular case the disregard also extends to the people in need in Japan.

News: 110429 JYJ sues Japanese agency over cancellation of concert JYJ has filed a lawsuit in Japan against their management company AVEX Entertainment for interfering with their attempt to hold a charity concert.

JYJ, a boyband formed by former TVXQ members Kim Jae-joong, Kim Jun-su, and Park Yoo-chun after they filed a lawsuit against SM Entertainment for unjust contract, had planned a charity concert to aid earthquake-affected areas in Japan. However, the concert’s venues have canceled their contracts with JYJ after AVEX allegedly pressured them.

JYJ’s agency C-JeS Entertainment and the concert organizer ZAK Corporation have filed two provisional dispositions against AVEX with the Tokyo District Court.

AVEX released an official statement, in which they do not deny the action. “Our company holds the exclusive rights for JYJ’s activities in Japan, and we have just taken actions against the infringement rightfully and properly,” AVEX said. They also claimed that they have received blackmails and threats due to the matter.

AVEX signed a contract with three members of JYJ in early 2010 after JYJ filed the lawsuit with SM Entertainment. A few months later, AVEX announced the “suspension of activities” of three members, arguing JYJ should refrain from promoting in Japan while legal proceedings against SM Entertainment were under way in Korea.

This “suspension of activities” has kept JYJ from conducting any promotional activities in Japan. Even after the suspension, however, AVEX has continued to make profits with products such as DVDs and JYJ footage.

Due to their ongoing lawsuit with their management company, JYJ has had difficulties in their activities in Korea as well. They have released an album, held concerts globally, and acted in dramas and musicals, but have had trouble getting airtime on television entertainment shows.

Another pop group, KARA, who also had three members embroiled in a dispute with their management company DSP for nearly 3 months, recently announced they have resolved the disagreement and will continue their career with DSP.

In any case, as a Korean Government employee and representative, my loyalty lies first and foremost to Korea before the Korean Wave. My responsibility is to serve Koreans—including the idol singers under SM—not the Korean Wave. JYJ’s fight and plight is clearly exposing that, under the circumstances engineered by companies like SM, the latter is destroying the former. The social context of the lawsuit and the certain characteristic elements of the Kpop fandom reveal that not everything associated with the Korean Wave is beneficial to Korea or Koreans. If anything, a great many aspects of the Korean idol boom and its internationalisation have left me deeply disturbed, if not downright afraid, on behalf of our singers and citizens. As attractive as the commercialised components of it are—the slick music videos, cool fashion and complex stage performances—it is ultimately disseminating the image of Koreans as disposable products or exotic performing circus monkeys. One only needs to peruse the comments on high-traffic English-language Kpop sites to understand that this way of marketing Korean artists does not necessarily garner respect for Koreans or genuine admiration for the country’s culture—a culture that survived its unfortunate geopolitical position, wars, neo-Confucian oppression/repression, annexation, division, extreme poverty and more to accomplish in 60 years what it took Western countries 200, a rare and unique example of economic development and citizenship empowerment. Surely such a culture and its descendants deserve far more than to be regarded as a disposable Internet byte.

Not too long ago, Korean netizens were fuming over articles, blog posts and/or cartoon strips originating from Japan that portrayed Korean girl groups as little more than sex objects[i]. Koreans attacked the Japanese for their racism and low regard for Koreans, but, in all seriousness, were they in a position to level such criticism? After all, it’s not as if girl groups or idols are regarded any differently in Korea—ultimately, they are all objects, sexual or otherwise. So, who can blame the Japanese, or any other non-Korean group of ‘fans’ for that matter, when they are simply acting on what they learned from the original source? Idol singers…written off as products in Korea…and thus treated as sexual objects everywhere else. If this is the face of the Korean Wave, I daresay it’s not worth preserving. For the security and moral integrity of our citizens, this kind of Korean Wave is best dismantled.

Without Korea there would be no Korean Wave, and without Koreans there would forcibly be no Korea. Therefore, I strongly believe that a sustainable Korean Wave will have at its centre talented Koreans (along with an accountable infrastructure that cultivates and supports their well-being and potential) NOT faceless, shameless entertainment companies.

Thus, inasmuch as SM needs JYJ to fail, Korea, and more specifically the Korean music industry, needs JYJ to succeed. Every stable, thriving and/or critically acclaimed music industry has artists occupying the middle ground between the commercialised pop idols and serious indie musicians, artists who act as the fulcrum, and buffer, harmonising the two extremes. Industry size ultimately doesn’t matter. This principle applies to the music market in the United States—where the likes of Madonna, Prince and Michael Jackson were allowed to grow from teen idols to music icons with merit in their own right—as well as the music markets of Iceland and South Africa, both of which have produced Grammy Award-winning artists[ii]. Korea needs artists like JYJ. The Korean Wave needs artists like JYJ, artists with pop idol roots but who grow to become acknowledged as artists in their own right, bringing stability to the entire industry by doing so and securing its future by sticking around to cultivate the next generation of pop singer-songwriters. And so I have always believed that not only JYJ fans but also those who truly value Korea, the Korean arts and the Korean Wave will support JYJ.

What the Korean Wave ultimately needs are leaders that, first of all, truly love Korea and also respect and understand the value of Art. Art is not a Slot Machine but a complex and capricious muse that will only play second-fiddle mistress to SadoMasochistic perverts for so long. By all indications, she has already grown tired of the game with said perverts and has found a new patron that truly appreciates her. The C’est si bon show, which gathered the artists of the Korean folk music movement of the 1960s and 70s for a studio concert that was broadcast live, garnered jaw-dropping ratings[iii], even among the young, and YG Entertainment is fast rising in prominence as a model for the future of Kpop business ethics and artistic success[iv] (though given its recent ill-judged dive into the cartel world through UAM, it remains to be seen if or, rather, how much, YG will sell out, since it will now have to harmonise its position with that of the likes of SM).

What the Korean Wave needs are more Seo Taijis and Yang Hyeonseoks (CEO of YG Entertainment) as opposed to Lee Soomans and Kim Youngmins, more DFSB Kollectives[v] as opposed to Melon or Dosirak, and an industry environment where the likes of Fluxus and C-JeS can compete alongside the likes of JYP and Cube.

And so, in the end, in attempting to leave my last words on JYJ, I have strayed far from our favourite trio and have ended up on policy recommendations for the sustainability of the Korean Wave. Nonetheless, I hope my readers can see the logical connections between all the points that got me here. Also, I hope that the readers of The JYJ Files can now see why I never considered JYJ’s plight to be a question of Kpop or fandoms but rather one of justice and State sovereignty. In fact, I believe SM has been trying for a long time to trivialise the matter into a conflict between fandoms, pitting in its discourse the JYJ fandom against either the HoMin fandom or the fandoms of other SM artists. In my view, it is so much bigger than that, and it is my wish that the international JYJ fandom does not fall to the trivialisation ruse. As I have said above, SM—in drafting and enforcing the kind of contracts that it did, in continually disobeying the mouthpiece of the Korean State, and in defrauding Korean taxpayers—has meddled in the one area the Korean State cannot tolerate—its exclusive sovereign authority—and consequently has come to symbolise the antithesis of post-G20 Korea and a force that hates the Republic of Korea and her citizens.

More than anything, I would like the international JYJ fandom to be a fandom that truly loves Korea and Koreans…that cares enough about Korea to have high expectations of it and hold it accountable to those expectations…a fandom that loves the members of JYJ as Koreans and human beings with talent. I don’t know how much I’ve convinced you that to love Korea in practicality means hating SM, but the only effective response will be to NOT get bogged down in fights with either the HoMin fandom or the fandom of other SM idols. At the most fundamental level, this is not a fight between SM fans and JYJ fans. It is not even a fight between SM and JYJ. It is a fight between the SM system and the Korean State. Therefore, I am convinced that the only effective response is to pressure the Korean Government. Continue writing and emailing relevant ministries and communicating with them through projects like the international fans’ petition. As international consumers of the Korean Wave who are fully aware of the prevailing conditions, you have immense potential to influence policy on the labour standards in the Korean entertainment industry and to effectively protect the artists you love.

In many ways, you boast a power Korean fans cannot even dream of, as the ripple effects of the international fans’ petition have already shown. I remember on the day of the interview I gave to the Chosun Ilbo, I told an impressed reporter that there were an unimaginable number of people outside of Korea who have never been to Korea before but who loved Korean culture. “Korean culture no longer belongs solely to Koreans,” I said, and this part made it to the actual article. What didn’t make it into the article is that I went on to say, “Now that Korean pop has garnered an audience beyond Korea and has gone truly global, it must meet the international expectations of its international audience. If only to retain the economic prowess and global appeal of Korean music, we cannot afford to ignore the opinions and demands of the international consumers.” These standards and expectations, being international, are ultimately yours to define, not Koreans’. Your mobilisation will thus benefit not only Kim Jaejoong, Park Yoochun and Kim Junsu, but future ambassadors of the Korean arts, music and pop culture as well. Ultimately, your voice will prove the most effective in realising positive change in the Korean pop music industry. As such, I consider you all (including all those who participated in the international fans’ petition) as true Friends of Korea and decent human beings. JYJ could not ask for better admirers, and Korea could not ask for better supporters. I thank you all immensely from the bottom of my heart. Please don’t change, and may your numbers grow.

Editors Note: My Perspective on the FanWars

I have been reading articles that attempt to explain the fanwars that have been raging for some time between Cassies over DBSK, now JYJ and HoMin. Black and white lines drawn down the middle of this enormous, emotional debacle that really do not define the true nature of the wars or the source. Human beings being held up as standards–immoveable, immutable standards

Why are there idols? Idols exist because we make them, not necessarily because they choose to be made. These are people who go to sleep at night; rise up and go about their day just like the rest of us. They get thirsty; they get hungry; they have spiritual, emotional and physical needs–just like the rest of us. Somehow, these needs get overlooked and we turn them into a production machine, designed to make us feel good and fulfilled. What about them?

Everyone is looking for someone to fufill those inner longings that are a part of each of us. We usually tend to choose those who represent who we would like to be–famous people; talented people; people of influence. Their sacrifice to complete our desires is enormous–hours and hours of work geared to pleasing us–sometimes pleasing them.

In the case of DBSK we have a much deeper situation than normal. The Internet has allowed many to view Jaejoong, Yunho, Yoochun, Junsu, and Changmin on stage and off stage. Candid shots and canned shots of the members laughing, singing, working, playing, vacationing… All designed to endear them to us, and so well-designed that it works. The objective of SM and others like them has been to sell the artists much like livestock in order to reap a profit. In return, we receive great music, artists to love, and somehow in the midst of it all–they love us. Theoretically, it works. In reality it is abusive.

So how does this relate to fan wars? When you have placed people on pedestals, and have not allowed them room to waver, or fail–you have created a situation that will eventually explode because there is no such person or personages. No one is capable of being on top indefinitely, nor of pleasing everybody all of the time. DBSK simply grew up. The babies that we all fell in love with became young men with their own identities, desires, and aspirations. By their very nature they are all competitive–both on stage and off. Ideally we want to see them smiling at each other constantly–in reality I am sure that tempers and tears flow abundantly.

Even being blessed with nuturing leaders such as Yunho and Jaejoong–it was inevitable for the tower to fall. Outside forces and inside forces drove the nails from the supports, and what was left was disappointment and disillusionment on all sides, including the fandom.

To keep ourselves healthy and stable–we cling to the hope that all will be healed. It is possible. Pray without ceasing. However, at present, with all of the discord among the fandom, it makes that goal even harder to reach. Misplaced emotions are being directed at each other–not at the system that fostered the illusion.

Or is it illusion? I don’t believe that it is. I believe that these young men never planned to deceive us or to disappoint us. The company did–not them. I believe that we also did some of that to ourselves, so I guess it is natural to now turn and rend our fan brothers and sisters? That is happening–but it doesn’t make it right.

So–where do we go from here? We have choices. We can love or hate; support or neglect each other or JYJCY. Our mancubs still need our love, more now than ever. They need to be seen and emoted to as fallible human beings. They also need our stability because this war has just begun. The enemy is still outside the camp. Are they happy that everyone is taking sides except for those of us who refuse to see things purely as black and white? I guarantee you they are not happy with this turn of events. Either we make the committment to love each other as much as we love our guys–or we fold up our campstools and exit the arena. All of them deserve our love; all are human as we are; and all of us can accomplish great things together if we but try. Momma Cha

The March 15 SM v. JYJ Hearing

1. The alleged reason why the [Dong Bang Shin Ki’s] members’ earnings were so little was that everything was attributed as overhead expenses. It was revealed today that what SM counted as overhead expenses included such comically ridiculous items as snacks, daily expenses of SM executives and staff, parking fees, cold medicine, meals, entertainers’ transportation (ie, plane, car), rent, concert agents’ costs, various taxes and expenses that should have obviously been covered and borne by SM.

2. SM claimed that in 2008, of the 14.7 billion won (roughly 14.7 million USD) in royalties earned that year only 1 billion won (roughly 1 million USD) came from Dong Bang Shin Ki, and the rest came from CSJH, BoA, the Trax and Koh Ara [T/N: A Korean actress under SM]. Those who know of Dong Bang Shin Ki’s popularity and selling power in Japan and abroad know how baseless this claim is. (The judge asked if Koh Ara really brought in more revenue than Dong Bang Shin Ki, at which SM’s side could not respond). At this point, many in the courtroom even burst out laughing.

3. In 2008, SM transferred the required 10% of digital download sales [to Dong Bang Shin Ki] but in 2009 didn’t even bother to do so.

4. The total earnings from the world tour amounted to 3.4 billion won (roughly 3.4 million USD), but of the amount that was supposed to go to the Dong Bang Shin Ki members, [SM] subtracted 900 million won (roughly 900,000 USD) as agents’ fees.

5. The money that was handed out as advances was later deducted as personal taxes. If only [SM] had done their accounting properly there would have been no need to pay such taxes on these advances.

6. The [Dong Bang Shin Ki] members were made to pay for the agents’ fees for their concerts abroad, music videos and even choreography expenses.

7. Even given the sales of Mirotic accounted at 480,000 units, [SM] was supposed to pay [the members] 50 million won (roughly 50,000 USD) but didn’t for the reason that the next album hadn’t come out yet.

8. In 2004, [the Dong Bang Shin Ki members] were accounted the 3-4 months’ worth of profits for the single “Hug”, but the accounting records reveal that after that they received nothing on the sale of their albums.

Ultimately, the [Dong Bang Shin Ki] members were burdened with all the costs.

So what exactly is SM insisting it invested? [T/N: the author is implying that SM’s justification that the financial arrangements in DBSK’s contract were necessary to recover investment costs is in fact one big, elaborate lie/fraud. All the major investments were made by the DBSK members; the DBSK members were in fact forced to invest in the company that supposedly invested in them]

What kind of calculation method is this?

The more they are active, the more they lose money…how is there anyone that thinks this makes any sense?

If this is how much SM screws around in court, one wonders how much more severe is their screwing around in real life.

All the information revealed at the hearing is the result of SM having tailored and bent the facts in their favour, and yet it still renders one appalled. One wonders how much more shocking the uncensored version is.

And now, the judgment that was originally due out today has been extended once more to a fourth hearing thanks to SM’s latest claims/antics.

But everyone, be aware of the truth.
